Welcome to WawSup! These Terms of Service govern your use of the WawSup! platform and services operated by Apex Horizon Digital. By accessing or using our services, you agree to be bound by these terms. Please read them carefully.
1Acceptance of Terms
By creating an account or using WawSup! services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using our services on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.
2Description of Services
WawSup! provides an AI-powered WhatsApp business automation platform that includes natural chat AI, omnichannel inbox management, CRM and pipeline tools, automated invoicing, broadcast messaging, and third-party integrations. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.
3User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it updated. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.
4Acceptable Use
You agree not to use WawSup! to send spam, unsolicited messages, or bulk messages that violate WhatsApp's terms of service. You must not use the platform for any illegal or unauthorized purpose, attempt to gain unauthorized access to our systems or other users' accounts, transmit viruses, malware, or other harmful code, impersonate any person or entity, or use the service in any way that could damage, disable, or impair our infrastructure.
5Payment & Billing
Paid plans are billed in advance on a monthly or yearly basis. All fees are non-refundable unless otherwise stated. We may change our pricing with 30 days' notice. Free trials are available as specified on our pricing page. If payment fails, we may suspend access to your account until payment is resolved. You are responsible for all applicable taxes associated with your use of the services.
6Intellectual Property
WawSup!, its logo, and all related trademarks, service marks, and trade names are the property of Apex Horizon Digital. You retain ownership of all content and data you submit to the platform. By using our AI training features, you grant us a limited license to process your conversation data solely for the purpose of improving your AI chat responses. We do not claim ownership of your data.
7Limitation of Liability
To the maximum extent permitted by law, WawSup! and Apex Horizon Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. We are not responsible for any actions taken by WhatsApp or Meta that may affect your use of our services.
8Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may terminate or suspend your access immediately if you violate these terms. Upon termination, your right to use the services will cease immediately. We will provide you with the ability to export your data for 30 days after termination.
9Indemnification
You agree to indemnify, defend, and hold harmless WawSup! and Apex Horizon Digital, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the services, your violation of these terms, or your violation of any rights of a third party.
10Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these terms shall be resolved through the courts of Indonesia. Both parties agree to submit to the exclusive jurisdiction of these courts.
11Changes to Terms
We reserve the right to update these Terms of Service at any time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Your continued use of the services after the effective date of the updated terms constitutes acceptance of the changes.
